BarVivant terms of service
Last updated October 22, 2026.
These terms are an agreement between you and Ninth Vale Holdings LLC ("we", "us"), which runs BarVivant. By creating an account or using BarVivant you agree to them. Please also read our privacy policy at https://barvivant.social/privacy-policy, which explains what we keep and how we use it.
Who can join
- BarVivant is a members only professional network for people who work in hospitality and the drinks industry.
- You must be 21 or older. We ask for your date of birth when you join and keep it private.
- BarVivant is invite only. You join through a member's invite link or an invite we send after reviewing a request. Signing in with Google does not create an account without an invite.
Your account
- One account per person. Use your real name and keep your details accurate.
- Keep your password and sign in safe, and don't share your account. You're responsible for what happens under it.
- Some features may ask you to verify where you work, for example with a pay stub. Documents you upload for verification are reviewed and then deleted, as the privacy policy explains.
- Your personal invite link is yours to share with people you'd vouch for. Members you invite are connected with you.
Sign in with Google
You can sign in with your Google account. When you do, Google shares your name, email address and Google account ID with us, and Google's own terms apply to your Google account. If an account already exists with the same email, Google signs you in to that account; it never creates a second one.
Using BarVivant well
BarVivant is a professional network. Treat people as you would in a bar you're proud to work in. You agree not to:
- harass, threaten, demean or discriminate against anyone;
- post anything illegal, sexually explicit, hateful or violent, or anything that promotes serving minors or overserving;
- pretend to be someone else, or misrepresent your job, workplace, credentials or organization;
- post someone else's private information, or messages, files or records you don't have the right to share;
- send spam, unwanted advertising or chain messages, or use BarVivant to collect members' information;
- upload viruses or harmful files, or try to get around access rules, security or limits;
- copy, scrape or resell BarVivant or what members post, or use automated tools to access it without our permission;
- create accounts for others, sell invites, or use invites to bring in people who don't work in the industry.
You can report a post or member, and block anyone. We review reports and may remove content or act on accounts that break these terms.
What you post
- You own what you post: your profile, posts, comments, messages, files, courses and other content.
- So we can run BarVivant, you give us permission to store, copy, display and share your content with the people your settings and the spaces you post in allow, and to make the copies and formats needed to do that (for example resizing photos or scanning files for viruses). This permission is not exclusive, costs nothing, and ends when you delete the content or your account, except for copies other people already have, content in shared spaces as the privacy policy describes, and backups kept for a limited time.
- Only post what you have the right to post. If you post work, photos, brand assets or documents that belong to someone else, make sure you have their permission.
- We may remove content that breaks these terms or the law.
Ideas and feedback
If you send us ideas, suggestions or feedback about BarVivant, we may use them freely, for any purpose, without owing you anything.
Copyright complaints
We respect copyright and expect members to do the same.
- If you believe something on BarVivant infringes your copyright, send a notice to hello@barvivant.social with: your name and contact details; the work you believe is infringed; a link to or description of the content on BarVivant; a statement that you believe in good faith the use isn't authorized by the copyright owner, its agent or the law; a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or are authorized to act for the owner; and your physical or electronic signature.
- When we receive a complete notice, we remove or disable the content and tell the member who posted it.
- If you believe your content was removed by mistake or misidentified, you can send a counter notice to the same address with: your name and contact details; the content that was removed and where it appeared; a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification; your consent to the jurisdiction of the federal court for the district where you live (or, if you live outside the United States, any district where we can be found) and to accept legal papers from the person who sent the notice; and your physical or electronic signature. We send the counter notice to the person who complained, and we may restore the content after 10 to 14 business days unless they tell us they have gone to court.
- We remove the accounts of members who repeatedly infringe copyright.
- Once we register a designated copyright agent with the U.S. Copyright Office, notices and counter notices go to that agent, whose details will be listed here.
Courses and education
- Members approved as educators can publish courses on BarVivant. Educators are responsible for their courses being accurate, lawful and theirs to share.
- Courses, quizzes, badges and certificates on BarVivant show learning on BarVivant. They are not an official qualification or accreditation unless the course says so and the issuing body confirms it. Credentials you add, such as WSET or Court of Master Sommeliers, are reviewed by BarVivant, but we can't guarantee them.
- The Official partner label appears only on courses BarVivant marks that way.
- BarVivant doesn't charge for courses today. We may offer paid features later; if we do, we'll show the price and terms clearly before anyone pays, and nothing free today will be charged for without your agreement.
Organizations
- Members can add organizations (such as venues, brands, distributors, agencies and clubs) and claim the ones they run. We may ask for proof before approving a claim and may remove a claim or page that isn't genuine. A verified badge means we checked; it is not an endorsement.
- An organization's owners and admins decide who joins its team and what goes in its private spaces, and are responsible for what their team posts there.
- Events, offers and requests on BarVivant are listed by members and organizations. BarVivant isn't a party to them and isn't responsible for them.
- Some features, such as Email Studio, are switched on by BarVivant for an organization. We may switch features on or off.
Client workrooms and the agency workspace
- An organization can run private client workrooms and invite people into them, including people outside BarVivant. The organization that runs a workroom decides who is invited and what they can see, and is responsible for having the right to share what it puts there, including receipts, documents and files.
- People outside BarVivant who use a workroom link may use only what they were given access to, and only for that client relationship.
- An organization that turns on the agency workspace and Telegram connection is responsible for linking only chats it has the right to save and for making sure people in those chats know. The bot posts a notice in every chat it is linked to.
- Records in client workrooms and the agency workspace belong to the organization that keeps them. We use them only to show them to the people with access.
Anonymous insights
As our privacy policy explains, we may combine information from across BarVivant so that it can no longer identify any person or organization, grouped across enough members that nobody can be singled out, and we may share or sell these anonymous insights, for example to brands for market research. These insights never include names, messages, files, or anything from client workrooms or the agency workspace. We never sell information that identifies you.
Our right to suspend or remove accounts
We may limit, suspend or remove an account, or remove content, if we reasonably believe it breaks these terms or the law, puts members or BarVivant at risk, or if we have to. Where it's safe and practical, we'll tell you why. You can leave BarVivant at any time and ask us to delete your account.
Disclaimers
- We work hard to keep BarVivant running well, but we provide it as it is and as available. We don't promise it will always be available, error free or secure.
- What members, educators and organizations post is theirs, not ours. We don't check everything and aren't responsible for it.
- Nothing on BarVivant is legal, financial, medical or professional advice.
- BarVivant relies on other services, such as hosting, email, file scanning, Google and Telegram. We're not responsible for their outages or changes, but we'll work to keep BarVivant running.
Limits of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill. Our total liability for any claim relating to BarVivant is limited to the amount you paid us in the three months before the claim, or US$50 if you haven't paid us anything. Some places don't allow these limits, so they may not apply to you.
Your responsibility for claims
If someone brings a claim against us because of content you posted or because you broke these terms, you are responsible for it, and you agree to cover us for the losses and reasonable costs that result, including reasonable legal fees. We'll tell you about the claim, and we may choose to handle it ourselves.
Changes to these terms
When we change these terms, the date at the top changes. For important changes, we tell members by email or in the app before they take effect. If you keep using BarVivant after a change takes effect, the new terms apply.
Law and disputes
These terms are governed by the laws of the State of Delaware.
- If you have a dispute with us, contact us first at hello@barvivant.social and give us 30 days to try to resolve it.
- If we can't resolve it, disputes go to the state or federal courts located in Delaware, and you and we agree to those courts' jurisdiction.
- Either of us can always take a claim to small claims court if it qualifies.
Transferring these terms
We may transfer these terms and BarVivant to an affiliate or a successor company, including a new company formed to run BarVivant, without you needing to agree again. You can't transfer your account to anyone else.
General
- If any part of these terms can't be enforced, the rest still applies.
- These terms and our privacy policy are the whole agreement between you and us about BarVivant.
- If we don't enforce part of these terms, that isn't a waiver; we can still enforce it later.
